d\u00e9cisions du 9 juillet 2025 ?\u00a0<\/strong><\/p><p>Par deux arr\u00eats d\u00e9cisifs rendus le 9 juillet 2025 (<a href=\"https:\/\/www.courdecassation.fr\/decision\/686e0296e0a6f0ca1546efce\">1\u00e8re chambre civile, pourvoi n\u00b0\u00a024-19.647<\/a>\u00a0;\u00a0<a href=\"https:\/\/www.courdecassation.fr\/decision\/686e0299e0a6f0ca1546efd2\">pourvoi n\u00b024-18.018, 9 juillet 2025<\/a>), la premi\u00e8re chambre civile de la Cour de cassation a op\u00e9r\u00e9 un revirement de jurisprudence attendu en mati\u00e8re de pr\u00eats immobiliers libell\u00e9s en francs suisses contract\u00e9s par des emprunteurs frontaliers.<\/p><h6>Pour la premi\u00e8re fois, la Haute juridiction reconna\u00eet que les emprunteurs percevant leurs revenus en francs suisses \u00e0 la date de souscription ne sont pas pour autant exclus du champ de protection attach\u00e9 au risque de change.<\/h6><p>Alors que les juridictions du fond estimaient jusque-l\u00e0 que les emprunteurs, notamment frontaliers, r\u00e9mun\u00e9r\u00e9s en CHF, \u00e9taient \u00e0 l\u2019abri d\u2019un tel risque, la Cour de cassation <span style=\"letter-spacing: 0.18px;\">consacre pleinement les exigences pos\u00e9es par la Cour de justice de l\u2019Union europ\u00e9enne (CJUE, 20 septembre 2017, affaire C-186\/16 <\/span><em style=\"letter-spacing: 0.18px;\">Andriciuc<\/em><span style=\"letter-spacing: 0.18px;\">) en mati\u00e8re de transparence des clauses relatives au risque de change.\u00a0<\/span><\/p><p>Ce contentieux complexe b\u00e9n\u00e9ficie ainsi d&rsquo;une \u00e9volution favorable importante r\u00e9sultant des d\u00e9cisions r\u00e9centes rendues par la Cour de justice de l&rsquo;Union europ\u00e9enne (CJUE) et par la Cour de cassation.<\/p><p>Ce changement ouvre la voie \u00e0 la reconnaissance du caract\u00e8re abusif des clauses de remboursement en devise \u00e9trang\u00e8re dans de tr\u00e8s nombreux contrats, en offrant la possibilit\u00e9 de demander l\u2019annulation de ces clauses et la restitution des sommes per\u00e7ues \u00e0 ce titre par les banques.<\/p><p>Depuis plus de dix ans, Dana Avocats accompagne de nombreux emprunteurs dans le cadre de ces l\u2019acquisition d\u2019un bien immobilier en France, destin\u00e9 \u00e0 devenir soit leur r\u00e9sidence principale soit un investissement immobilier locatif.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3122881 elementor-widget elementor-widget-text-editor\" data-id=\"3122881\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>La client\u00e8le des frontaliers suisses, qui per\u00e7oivent des revenus en francs suisses depuis la Suisse mais vivent en France, \u00e9tait particuli\u00e8rement recherch\u00e9e par les banques frontali\u00e8res qui obligeaient les emprunteurs frontaliers suisses, qui souhaitaient acqu\u00e9rir un bien immobilier situ\u00e9 en France au moyen d&rsquo;un pr\u00eat immobilier, \u00e0 financer leurs acquisitions au moyen de pr\u00eats en francs suisses, remboursables dans cette m\u00eame devise.<\/p><p>L&rsquo;argument commercial soutenu par les banques \u00e9tait que le taux d&rsquo;int\u00e9r\u00eat de ce type de pr\u00eats en francs suisses \u00e9tait inf\u00e9rieur \u00e0 un cr\u00e9dit immobilier en euros et que les emprunteurs ne seraient pas expos\u00e9s au risque de change compte tenu de leurs revenus en francs suisses.&nbsp;<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-inner-column elementor-element elementor-element-16dee68\" data-id=\"16dee68\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div their installments in Swiss francs using their Swiss income, without foreign exchange transactions and avoiding making international also been granted to investors and companies wishing to finance a rental property investment located in France, benefiting, where applicable, from a tax exemption regime.<\/p><p>They have also been granted to local authorities.<\/p><h4 data-pm-slice=\"1 1 []\">Le risque de change<\/h4><p>Cependant, les banques ont omis d&rsquo;indiquer, de mani\u00e8re claire et compr\u00e9hensibles, aux emprunteurs, frontaliers et non frontaliers, qu&rsquo;ils s&rsquo;exposaient obligatoirement \u00e0 un risque de change en finan\u00e7ant le prix d&rsquo;acquisition d&rsquo;un bien immobilier en euros au moyen d&rsquo;un pr\u00eat immobilier en francs suisses.<\/p><p>Le risque de change r\u00e9sulte de l&rsquo;ensemble contractuel constitu\u00e9 de la vente immobili\u00e8re libell\u00e9e en European Union has recently ruled that Article 4(2) of European Council Directive 93\/13\/EEC of 5 April 1993 on unfair terms in consumer contracts, must be interpreted as meaning that the requirement seulement conna\u00eetre la possibilit\u00e9 de hausse ou de d\u00e9pr\u00e9ciation de la devise \u00e9trang\u00e8re dans laquelle le pr\u00eat a \u00e9t\u00e9 contract\u00e9, mais aussi \u00e9valuer les cons\u00e9quences \u00e9conomiques, potentiellement significatives, d\u2019une telle clause sur ses obligations financi\u00e8res (CJUE, 20 septembre 2017, Ruxandra Paula, aff.
